Purposes of the processing

Gert Taeymans BV collects and processes customers’ personal data for customer and order management (customer administration, order / delivery follow-up, invoicing, solvency follow-up, profiling and the sending of marketing and personalised advertising).

Legal foundation for the processing

Personal data is processed based on several provisions of Article 6.1.

(a)  consent, which you can revoke at any time,

(b) required for the implementation of an agreement between you and Gert Taeymans BV, eg. when you enter into a contract with us,

(c)  required to satisfy a legal obligation

(f)  (required for the protection of our legitimate interest in entrepreneurship)] of the General Data Protection Regulation. An actual data item may be subject to multiple provisions.

Transfer to third parties

Due to the ECJ striking down the  EU-US Privacy Shield agreement, this leaves us with a open gap. The resulting implications and actions to take are not yet clear. You must be aware that one can argue that any data transfer from the EU towards the US is now in breach of the law. Other argue that necessary transfers are still allowed, whithout however defining, as far as we know, what "necessary" actually means. Gert taeymans BV is investigating what this exactly means fo you, our user, and us as a company. This website runs on servers within the EU. We also closely follow the opinions by the scholars and our regulator.

Retention period

Personal data processed for customer management will be stored for the time necessary to satisfy legal requirements (in terms of bookkeeping, among others).

Right to inspection, improvement, deletion, limitation, objection and transferability of personal data

You have at all times the right to inspect your personal data and can have it improved should it be incorrect or incomplete, have it removed, limit its processing an object to the processing of their personal data based on Article 6.1 (f), including profiling based on said provisions. Any personal data however that is needed for the legal processing of your order cannot be removed after you placed an order, as we need to keep it for legal purposes.

Furthermore, you are entitled to obtain a copy of your personal data and to have said personal data forwarded to another company.

GDPR, Implemented!

GDPR, Are You really ready?

It is now 2020 and the GDPR has been in effect for almost 2 years. Many companies thought: been there, done that. And for a while the regulators let some time go by.

The first warnings appeared quickly enough. Eg; in September 2018, the French regulator warned a company that they needed to get consent of their customers for getting geolocation based data.

That same month, an airline was hacked and, on top of the reputational damage and costs to fix the IT systems, it faced the threat of a stiff fine.

Even though we not have really noticed, fines started being imposed as early as January 2019.

But these fines, that is when you have material breaches...

Wrong! The fines are levied in a number of cases. And to make it difficult to estimate, there are guidelines that will shape the decision making process, but no hard and fast rules!

The GDPR is very complex and consists of both articles and associated recitals that you need to be in compliance with. it is amuch about the letter as it is about the spirit.

We have a clear view on what most of those cases are.
And more importantly, when you follow our guidelines, you will be well placed to answer any questions by your clients and cooperate with the regulator in a proactive way.

They will never come after me. I'm too small.

Company size has nothing to do with it.

While in the beginning, it seemed mostly a game for the big players (for names, you have to contact us) that is just perception.

As early as March 2018 a €10M revenue company was fined around €120,000. 2 days later another company with operating revenues of  around €6.2M was fined close to €200.000 for failing to abide by the DSRR stipulatons.

Terms and Conditions for consulting to businesses

By signing an agreement with Gert Taeymans bvba, Client declares that he agrees with the Terms and Conditions referred to hereafter. Terms and conditions on Client's order form or any other similar document shall not be binding upon Gert Taeymans bvba.

The prices, quantities and delivery time stated in any quotation are not binding upon Gert Taeymans bvba. They are commercial estimates only which Gert Taeymans bvba will make reasonable efforts to achieve. Prices quoted in final offers will be valid only for 30 days. All prices are VAT excluded and do not cover expenses, unless otherwise agreed in writing. Gert Taeymans bvba reserves the right to increase a quoted fee in the event that Client requests a variation to the work agreed.

The delivery times stated in any quotation are of an indicative nature and not binding upon Gert Taeymans bvba, unless otherwise agreed in writing. Delivery times will be formulated in working days. In no event shall any delay in delivery be neither cause for cancellation of an order nor entitle Client to any damages.

Amendments or variations of the initial agreement between Client and Gert Taeymans bvba will only be valid when accepted by both parties in writing.

Any complaints concerning the performance of services must be addressed to Gert Taeymans bvba in writing and by registered mail within 7 working days of the date of the performance of the services.

In no event shall any complaint be just cause for non-payment or deferred payment of invoices. Any invoice and the services described therein will be deemed irrevocably accepted by Client if no official protest of non-payment has been sent by Client within 7 working days from the date of the mailing of the invoice.

Client shall pay all invoices of Gert Taeymans bvba within thirty (30) calendar days of the date of invoice unless otherwise agreed in writing by Gert Taeymans bvba. In the event of late payment, Gert Taeymans bvba may charge a monthly interest on the amount outstanding at the rate of two (2) percent with no prior notice of default being required, in which case each commenced month will count as a full month. Any late payment will entitle Gert Taeymans bvba to charge Client a fixed handling fee of 300 EUR. All costs related to the legal enforcement of the payment obligation, including lawyer fees, will be charged to Client.

In no event will Gert Taeymans bvba be liable for damages of any kind, including without limitation, direct, incidental or consequential damages (including, but not limited to, damages for lost profits, business interruption and loss of programs or information) arising out of the use of Gert Taeymans bvba services.

Gert Taeymans bvba collects personal data from Client for the performance of its services and the execution of its contracts. Such personal data can also be used for direct marketing, allowing Gert Taeymans bvba to inform Client of its activities on a regular basis. If Client objects to the employment of its personal data for direct marketing, Client must inform Gert Taeymans bvba on the following address: gert@gerttaeymans.consulting.

Client can consult, correct or amend its personal data by addressing such request to Gert Taeymans bvba by registered mail. Personal data shall in no event be sold, rented or made available to other firms or third parties where not needed for the execution of the contract. Gert Taeymans bvba reserves the right to update and amend its privacy policy from time to time to remain consistent with applicable privacy legislation.

The logo of the Client will be displayed on the Gert Taeymans bvba website, together with a short description of the project/services.

Any changes to Client’s contact information such as addresses, phone numbers or e-mail addresses must be communicated to Gert Taeymans bvba as soon as possible during the project.

Both parties shall maintain strict confidence and shall not disclose to any third party any information or material relating to the other or the other's business, which comes into that party's possession and shall not use such information and material. This provision shall not, however, apply to information or material, which is or becomes public knowledge other than by breach by a party of this clause.

Gert Taeymans bvba has the right at any time to change or modify these terms and conditions at any time without notice.

The agreement shall be exclusively governed by and construed in accordance with the laws of Belgium. The competent courts of Antwerp, Belgium will finally settle any dispute about the validity, the interpretation or the execution of this agreement.

These Terms and Conditions are the only terms and conditions applicable to both parties.

If any provision or provisions of these Terms and Conditions shall be held to be invalid, illegal or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

 These Terms of Use state the terms and conditions under which you may use this website and the Services, which are the property of Tymans Group BV. ("TY"). Your use of this site and the Services constitutes acceptance of these Terms of Use.

User may use the Services solely for his or their own information purposes pursuant to the terms and limitations of the paid subscription. The User may download any of the Service's tools or templates for his or her individual use but may not distribute any articles, tools, templates, or blueprints internally, subject to the exceptions below. The User may create derivative works from the Service's tools or templates and distribute these for internal use but may not distribute these derivative works externally for any commercial or resale purposes.

Any other reproduction or dissemination of the Services in any form or by any means is forbidden without TY's written permission, and without limiting the generality of the foregoing, the User will not:

  • A. record and re-transmit the Service over any network (including any local area network), except as otherwise stated above;

Users must be authorized to use the Services by TY. Users must maintain and protect the confidentiality of any password(s) and are responsible for ensuring that the passwords are effective. If you are an organization that is party to a service agreement with TY, references in these Terms of Use to "User(s)" include you, and you are responsible for compliance by named individual Users within your organization with these Terms of Use.

  1. User Perspective

For the benefit of all Users, TY's research services include the ability for Users to (i) participate in the creation of research by contributing User perspectives for publication on TY's websites and (ii) participate in industry-specific community groups and other forums by contributing discussion posts. All such contributions are voluntary with the full consent of the User. If your account is used to contribute content to TY's websites (collectively, "User Contributions"), you agree to accept sole responsibility for those User Contributions, including the information, statements, facts, and material contained in any form or medium (e.g., text, audio, video, and photographic) therein. To the extent Users contribute any feedback to TY (as User Contributions or otherwise), TY may use that feedback to assess, improve, and market its products. Although you are solely responsible for the content you provide, and we do not have a policy of reviewing or monitoring all User Contributions, we reserve the right to pre-screen and/or monitor User Contributions. If we become aware of User Contributions that violate these Terms of Service or that we believe to be otherwise objectionable, we may reject or delete them or take other action without notice to you and at our sole discretion.

  1. Non-Disclosure of Confidential Information

In these Terms of Use, "Confidential Information" means information of a commercially sensitive or proprietary character that is marked as confidential or that a reasonable person would understand to be confidential. The "Disclosing Party" is the party disclosing Confidential Information, and the "Receiving Party" is the party receiving Confidential Information. However, Confidential Information does not include information that:

  • was in the public domain at the time of communication to the Receiving Party or is later placed in the public domain by the Disclosing Party;
  • entered the public domain through no fault of the Receiving Party subsequent to the time of disclosure hereunder to the Receiving Party;
  • was in the Receiving Party's possession free of any obligation of confidence prior to disclosure hereunder; or
  • was developed by employees or agents of the Receiving Party independently of and without reference to any Confidential Information.

The Receiving Party shall not disclose, publish or communicate the Confidential Information to any third party without the prior written consent of the Disclosing Party. However, the Receiving Party may disclose the Confidential Information to a third party who has a need to know the Confidential Information and (i) is an accountant, attorney, underwriter, or advisor under a duty of confidentiality; or (ii) is under a written obligation of confidentiality at least as restrictive as this Agreement and to the extent required by law.

TY may create or use anonymized data for purposes such as benchmarking, analytics, and other good-faith business purposes. Anonymized data is not the Confidential Information of Users.

  1. Term

Many of the Services are "subscription" services that have a fixed Term and must be renewed in writing at the end of the term for services to continue. The contractual term of membership is generally one (1) to three (3) years in length and is agreed to by the parties in writing. Workshops purchased as part of membership expire without refund or credit at the end of the membership period covered by the purchase. Workshops purchased outside membership expire without refund or credit one (1) year after purchase. TY may terminate a User's access at any time if the User or the entity paying for the User's access violates the terms of use or subscription or any other agreement with TY.

  1. Cancellation

As the Services are paid in advance for a committed membership term, a service agreement or membership cannot be terminated by a User for convenience during a contractual term.

  1. Changes

TY strives to innovate. TY may update, upgrade or otherwise change or discontinue content, features, or other aspects of its Services. TY will not make changes that cumulatively degrade the quality of a paid subscription to the Services. TY also reserves the right to change the terms and conditions applicable to your use of the Services unless TY has otherwise agreed in a service agreement. Use of the Services after such changes shall be deemed to be acceptance by the User of such changes. These terms were last revised on June 8, 2022.

  1. Accuracy of Information and Warranty

The information contained in the Services has been obtained from sources believed to be reliable, but TY does not warrant the completeness, timeliness, or accuracy of any information contained in the Services.   • Does this work for less than 25 employees?

    Resilience is not size-dependent. That said, if you are supplying critical services to financial services firms, you may not have a choice. In that case, be prepared to up your game. Call TY in this case. We can help you fulfill third-party requirements, such as the DORA regulation.

    In other cases, if you plan to grow your company beyond 25 employees, then yes. Start with the basics through. Make sure you have a good understanding of your current challenges. 

    If you are just starting out and want to ensure that your company's processes are correct right out of the gate, it's better to give me a call so that we can start you off in the right direction without spending too much.

  • I'm a small business owner, can I do all this by myself?

    See also the above question about company size and target clients. If you have fewer than 25 employees and you are not supplying critical services to financial institutions, then maybe some of our guides are not for you. We can still help you organize your resilience, but it may be more cost-effective to use only our TY Advisor services.
